What is a rent increase notice?

A rent increase notice is a letter from a landlord telling a tenant that the rent will go up, by how much and from when. It gives the tenant time to plan, or to discuss the change before it applies.

Most rent agreements say how and when rent can be increased, often a fixed percentage on renewal. The notice should follow those terms.

Rent increase notice format

A rent increase notice shows the date, the tenant's name and the property, the current rent, the new rent in figures and words, the percentage increase, the date it applies from, the agreement clause that allows it, an optional reason, and the landlord's signature.

In states that follow the Model Tenancy Act, give at least three months' written notice before the new rent applies, unless the agreement says otherwise.

How much can a landlord increase rent in India?

As much as the rent agreement allows; many agreements set 5–10% on renewal. Some states' rent laws set their own limits.

How much notice is needed for a rent increase?

What your agreement says. Under the Model Tenancy Act, where adopted, it's at least three months' written notice.

Can rent be increased during the agreement?

Only if the agreement allows it. Otherwise, the rent stays the same until the agreement is renewed.

What if the tenant doesn't agree?

Discuss it. If the agreement allows the increase, it applies; if not, either side can choose not to renew when the term ends.

Should the new rent be in a fresh agreement?

On renewal, yes: write the new rent into the renewed agreement. The notice is enough during an existing agreement that allows increases.
