What is a notice to vacate?

A notice to vacate is a written notice ending a tenancy. A landlord sends one to ask the tenant to leave by a date; a tenant sends one to tell the landlord they're moving out. Either way, it fixes the date and starts the handover: final rent, bills, inspection and deposit refund.

Give at least the notice period in your rent agreement, usually one or two months, and send it in a way you can prove, such as email plus a signed copy.

Notice to vacate format

A notice to vacate shows the date, who it's from and to, the property address, the rent agreement it relates to, the date to vacate by, an optional reason, what should be settled before leaving, and how the security deposit will be handled. It's signed by the sender.

A landlord can't force a tenant out without following the law: if a tenant won't leave after notice, the landlord must go to the Rent Authority or court.

Rules that apply

Eviction only through the law

In states that adopt the Model Tenancy Act, a landlord can recover possession only as the agreement and the Act allow, through the Rent Authority, not by force or by cutting off supplies.

Good to know

How much notice must a landlord give a tenant?

What your rent agreement says, usually one or two months. Without an agreed period, a month's notice is the common practice.

How do I write a notice to vacate as a tenant?

Give your last day, the property address and your agreement date, promise to clear dues, and ask for the deposit refund at handover.

Can a landlord evict without notice?

No. The landlord must give notice and, if the tenant doesn't leave, go through the Rent Authority or court.

When should the deposit be refunded?

Usually at handover, after a joint inspection, less any unpaid rent, bills or damage, as per your agreement.

Should the notice be on stamp paper?

No. A signed letter is enough; send it by email or courier so you have proof of the date.

Is my data stored anywhere?

No. The notice is made in your browser and its details never leave your device.
