What is a rent agreement?

A rent agreement (also called a rental or leave and licence agreement) is the written contract between a landlord and a tenant. It records the rent, security deposit, term, notice period and the rules both sides agree to, so there's no argument later.

Most residential agreements in India are for 11 months, because a lease of 12 months or more must be registered at the sub-registrar's office. Shorter agreements still need the right stamp duty.

Rent agreement format

A rent agreement names the landlord and tenant with their addresses, describes the property, and sets out numbered clauses: term, rent and due date, security deposit and refund, increase on renewal, bills and maintenance, permitted use, sub-letting, repairs, inspection, lock-in and notice, handover and disputes. Both parties sign each page, with two witnesses.

Print it on non-judicial stamp paper of the value your state requires, or buy e-stamp paper online, before signing. Some states, like Maharashtra, require leave and licence agreements to be registered whatever their length.

Rules that apply

Leases of 12 months or more must be registered

A lease of immovable property for more than a year, or from year to year, must be registered; an unregistered one can't be relied on as evidence of the lease.

Stamp duty on rent agreements

Rent agreements and leases attract stamp duty, which depends on the state, the rent and the term. Pay it before signing, through stamp paper or e-stamping.

Deposit cap under the Model Tenancy Act

In states that adopt the Model Tenancy Act, the security deposit is capped at two months' rent for homes and six months' rent for other premises.

Good to know

Why are rent agreements made for 11 months?

Because a lease of 12 months or more must be registered at the sub-registrar's office, which costs more time and fees. An 11-month agreement avoids that in most states.

Is a rent agreement valid without stamp paper?

An unstamped agreement can't be used as evidence until the duty and a penalty are paid. Print it on stamp paper or e-stamp it before signing.

How much stamp duty is payable on a rent agreement?

It depends on your state, the rent, the deposit and the term. Check your state's stamp duty rates or e-stamping portal.

Do both parties need to sign every page?

It's good practice: both sign every page and the last page with two witnesses, so no page can be swapped later.

Is a notarised rent agreement valid?

Notarising adds proof of signing, but it doesn't replace stamp duty or, for 12 months or more, registration.

Is my data stored anywhere?

No. The agreement is made in your browser and its details never leave your device.
