What is an affidavit?

An affidavit is a written statement of facts that you (the deponent) swear or affirm to be true, signed before a notary or oath commissioner. Offices, colleges, banks and courts ask for affidavits to correct a name or date of birth, confirm an address, declare income or relationship, or explain a lost document.

Making a false statement in an affidavit is a criminal offence, so state only facts you know to be true.

Affidavit format

An affidavit opens with your name, your father's or spouse's name, your age and address, and "do hereby solemnly affirm and declare as under". It lists each statement as a numbered point, ends with a verification that the contents are true and nothing has been concealed, and is signed by you with the place and date. The notary or oath commissioner then attests it with their seal.

It's usually printed on non-judicial stamp paper of the value your state requires. Check with the office that asked for it whether they want a specific wording or stamp value.

Rules that apply

Signed before a notary or oath commissioner

Stamp duty on affidavits

Affidavits attract stamp duty, which is set by each state; many are printed on ₹10–₹100 non-judicial stamp paper. Some uses, such as court filings, are exempt.
