Why are rent agreements made for 11 months?

Updated · Sources linked below

Because a lease of a year or more must be registered at the sub-registrar's office; an 11-month agreement avoids compulsory registration and its fees in most states.

The registration rule

Under the Registration Act, a lease of immovable property for more than a year, from year to year, or reserving a yearly rent must be registered. An unregistered lease of that kind can't be relied on as evidence of the lease in court.

What 11 months doesn't save

  • Stamp duty: an 11-month agreement still needs stamp paper or e-stamping at your state's rate. Unstamped, it can't be used as evidence until duty and penalty are paid.
  • Tenant rights under your state's rent law, which apply however long the agreement is.
  • Maharashtra: leave and licence agreements must be registered whatever their length.

When to register anyway

Register if you want a longer fixed term with a lock-in, if the rent or deposit is large, or for shops and offices where the tenant invests in fit-outs. A registered agreement is stronger evidence if there's ever a dispute.

Questions people also ask

Is an 11-month rent agreement legal?

Yes. It's a valid agreement; it just stays under the one-year limit for compulsory registration, but still needs stamp duty.

Does a rent agreement need to be notarised?

Notarising isn't required by law. It adds proof of signing but doesn't replace stamp duty or registration.

What happens after 11 months?

Sign a fresh agreement, usually with the agreed rent increase, on new stamp paper.

Is registration compulsory in Maharashtra?

Yes. In Maharashtra leave and licence agreements must be registered whatever their term; online registration is available.
