Is landlord PAN mandatory for HRA?

Updated · Sources linked below

Yes, but only if you pay more than ₹1 lakh in rent a year (about ₹8,333 a month); below that, your employer can allow HRA without your landlord's PAN.

The ₹1 lakh rule

Your employer deducts tax from your salary and gives you the HRA exemption based on the proofs you submit. When the rent you pay in the year is more than ₹1 lakh, the employer must also have your landlord's PAN before allowing the exemption.

Yearly rentMonthly equivalentLandlord PAN needed?
Up to ₹1,00,000Up to ₹8,333No
More than ₹1,00,000More than ₹8,333Yes, or the landlord's declaration if they have no PAN

The limit is for the whole year's rent, not each month. ₹9,000 a month for 12 months is ₹1,08,000, so PAN is needed.

What if my landlord has no PAN?

If your landlord genuinely doesn't have a PAN, get a signed declaration from them saying so, with their name and address, and submit it with your rent receipts. Your employer can accept that in place of the PAN.

  • Landlord's full name and address
  • Address of the rented home
  • A statement that they don't have a PAN
  • Their signature and the date

What to submit to your employer

  1. Rent receipts for each month (or quarter), signed by the landlord, with a ₹1 revenue stamp on cash receipts above ₹5,000.
  2. Your landlord's PAN if the yearly rent is over ₹1 lakh, or their no-PAN declaration.
  3. Your employer's investment-proof form or HRA declaration, filled in with the rent and period.

HRA exemption is only available under the old tax regime, so you need these proofs only if you've opted for it.

Questions people also ask

Is landlord PAN needed if rent is ₹8,000 a month?

No. ₹8,000 a month is ₹96,000 a year, which is under ₹1 lakh, so your employer doesn't need your landlord's PAN.

Can I put a fake PAN on rent receipts?

No. The PAN is checked against the landlord's tax records, and a wrong PAN can lead to the exemption being withdrawn with tax and penalty.

Does my landlord have to pay tax if I give their PAN?

The rent is their income either way. Giving the PAN only means it can be matched with their tax return.

Do I need PAN if I pay rent to my parents?

Yes, the same ₹1 lakh rule applies. Your parent's PAN goes on the receipts, and they show the rent as their income.
